Do I Need to File 2290 as an Owner-Operator?
If you own a highway motor vehicle with a taxable gross weight of 55,000 pounds or more, the answer is yes. It does not matter whether you run under your own operating authority, lease onto a motor carrier, or haul freight as an independent contractor. The IRS looks at one thing: who is the registered owner of the vehicle. If that is you, the filing obligation is yours.
Taxable gross weight means the unloaded weight of your truck (or tractor-trailer combination) plus the maximum load it is designed to carry. Most Class 8 trucks used in long-haul and regional operations clear the 55,000-pound threshold easily. If your vehicle weighs less than 55,000 pounds, you do not need to file Form 2290.
There is one exception worth knowing about: if you drive fewer than 5,000 miles on public highways during the tax period (or 7,500 miles for agricultural vehicles), you still file Form 2290, but your vehicle qualifies for suspended status with $0 tax due. You will still receive a stamped Schedule 1, which you need for DMV registration.
Getting Your EIN
Every Form 2290 filing requires an Employer Identification Number (EIN). This is a 9-digit number (formatted XX-XXXXXXX) assigned by the IRS to identify your business. You cannot use your Social Security Number to file Form 2290, even if you are a sole proprietor with a single truck.
If you already have an EIN from setting up your trucking business, use that same number. If you do not have one yet, applying is free and straightforward. Go to IRS.gov's EIN application page and complete the online form. The application is available Monday through Friday, 7 a.m. to 10 p.m. Eastern Time, and your EIN is issued immediately when you finish.
Important: If you just received a brand-new EIN, wait at least two weeks before e-filing your Form 2290. The IRS databases need time to propagate your new number. Filing too soon can result in a rejection. Be cautious of third-party websites that charge fees for EIN applications β the IRS never charges for this.
What Information You Need

Vehicle Identification Number (VIN)

Unloaded weight of your vehicle plus the maximum load it is designed to carry. For tractor-trailer combinations, include the tractor, trailer, and maximum payload. Your weight category determines how much HVUT you owe.
First-Use Month
The month during the current tax period (July through June) when you first drove the vehicle on public highways. For trucks already in service at the start of the period, the first-use month is July.
